About These Terms
These terms govern your use of Pixelflare instances operated by Alicia Sykes. If you're using a self-hosted instance operated by someone else, please refer to that operator's terms of service.
By accessing or using the service, you agree to be bound by these terms.
Service Provider
Pixelflare is operated by:
- Alicia Sykes (Individual)
- Jurisdiction: United Kingdom
Eligibility
You must be at least 13 years old to use this service. By using the service, you represent that you meet this age requirement.
Account Registration
- You must authenticate via GitHub OAuth to use the service
- You are responsible for maintaining the security of your account
- You must provide accurate information
- You may not share your account with others
- You must notify us immediately of any unauthorized access
Acceptable Use
You agree not to:
- Upload illegal content (including but not limited to: child exploitation material, terrorist content, content that violates UK law)
- Upload content that infringes on intellectual property rights
- Upload malware, viruses, or malicious code
- Use the service to spam, harass, or abuse others
- Attempt to gain unauthorized access to the service or other users' accounts
- Circumvent rate limits or security measures
- Use the service for any unlawful purpose
- Upload content designed to deceive or mislead (deepfakes, impersonation)

Your Content
Ownership
You retain all ownership rights to content you upload. We do not claim ownership of your images or data.
License to Us
By uploading content, you grant us a limited, non-exclusive license to:
- Store your images
- Serve your images via CDN
- Perform image transformations (resizing, format conversion) as requested
- Create backups (if enabled)
This license ends when you delete your content or close your account.
Your Responsibility
You are solely responsible for:
- All content you upload
- Ensuring you have rights to upload and share the content
- Complying with applicable laws
- Any consequences arising from your uploaded content
We are not responsible for user-generated content and do not review content prior to upload.
Service Availability
No Warranties
The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Service Modifications
We reserve the right to:
- Modify or discontinue features at any time
- Perform maintenance that temporarily interrupts service
- Update these terms with reasonable notice
No SLA
We do not guarantee any specific uptime or service level. The service may be unavailable due to maintenance, technical issues, or other factors beyond our control.
Paid Features
The service is currently free to use. We may introduce paid tiers or premium features in the future. If we do:
- Free tier users will be notified in advance
- Paid features will be clearly marked
- Payment terms will be provided before purchase
- Existing features will remain free or clearly grandfathered
Content Removal
We reserve the right to remove content that:
- Violates these terms
- Violates applicable law
- Is reported and determined to be inappropriate
- Poses security risks
We will make reasonable efforts to notify you before removing content, except in cases of illegal content or immediate security threats.
Account Termination
By You
You may close your account at any time through the settings page. Upon closure:
- Access to your account will be immediately disabled
- Your images will enter a 30-day deletion period
- All data will be permanently deleted after 30 days
By Us
We may suspend or terminate your account if you:
- Violate these terms
- Violate our Acceptable Use Policy
- Engage in illegal activity
- Pose a security risk to the service or other users
We will provide notice before termination except in cases of illegal activity or immediate security threats.
Data and Privacy
Your use of the service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
Intellectual Property
Pixelflare Software
Pixelflare is open-source software licensed under the MIT License. See License for details.
Trademarks
"Pixelflare" and associated logos are the property of Alicia Sykes. You may not use these marks without permission.
Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- We are not liable for loss of profits, data, use, goodwill, or other intangible losses
- We are not liable for service interruptions or data loss
- Our total liability shall not exceed £100 GBP or the amount you paid us in the last 12 months (whichever is greater)
This limitation applies regardless of the legal theory (contract, tort, negligence, etc.) and even if we've been advised of the possibility of such damages.
Indemnification
You agree to indemnify and hold harmless Alicia Sykes from any claims, damages, liabilities, and expenses (including legal fees) arising from:
- Your use of the service
- Your uploaded content
- Your violation of these terms
- Your violation of any law or third-party rights
Disputes and Governing Law
Governing Law
These terms are governed by the laws of England and Wales, without regard to conflict of law principles.
Jurisdiction
Any disputes shall be resolved in the courts of England and Wales.
Informal Resolution
Before filing a claim, please contact us to attempt informal resolution.
Changes to These Terms
We may update these terms from time to time. Changes will be effective when posted with an updated "Last Updated" date.
Significant changes will be communicated through:
- Notice on the service
- Email to registered users (if email is available)
Continued use of the service after changes constitutes acceptance of the updated terms.
Self-Hosted Instances
If you deploy your own Pixelflare instance:
- You are responsible for creating your own terms of service
- These terms do not apply to your instance
- You must comply with all applicable laws and regulations
- You are responsible for moderating content on your instance
The Pixelflare software is provided under the MIT License without warranties or support.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement
These terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and us regarding the service.
